Purpose

The site is operated in compliance with Swiss law. Use of this site is governed by this legal notice and the privacy policy, which define the terms on which the site’s services (the “Service”) are made available and the conditions of use of the Service by the User. Any access to and/or use of the site implies the unconditional acceptance of, and compliance with, all the terms of this legal notice and the privacy policy. They therefore constitute a contract between the Service and the User. Should the User not wish to accept all or part of this legal notice, they are asked to refrain from any use of the Service.

Definitions

Site: the term “Site” refers to implecio.com.
User: any person who uses the Site or one of the services offered on the Site.
Service: all the offers and editorial content available on the Site.

Access to the service

The Service is accessible free of charge to any User with internet access. All costs related to accessing the Service, whether hardware, software or internet access costs, are borne exclusively by the User, who is solely responsible for the proper functioning of their equipment and internet access.

Implecio Sàrl reserves the right to refuse access to the Service, unilaterally and without prior notice, to any User who does not comply with these terms of use. Implecio Sàrl uses all reasonable means at its disposal to ensure quality access to the Service, but is under no obligation to achieve it.

Implecio Sàrl cannot be held liable for any malfunction of the network or servers or any other event beyond its reasonable control that prevents or degrades access to the Service. Intellectual property

Any unauthorised partial or complete reproduction of the Site’s content, trademarks, logos and distinctive signs constitutes an infringement liable to civil and criminal penalties. The User is solely responsible for the User Content they publish through the Service and for the texts and/or opinions they express, and undertakes that such data will not harm the legitimate interests of any third party.

The User accordingly indemnifies Implecio Sàrl against any claim, directly or indirectly based on such statements and/or data, that may be brought by anyone against Implecio Sàrl, and undertakes in particular to bear any sums resulting from a third-party claim against Implecio Sàrl, including legal fees and court costs. Implecio Sàrl reserves the right to delete all or part of the User Content at any time and for any reason, without prior warning or justification. The User may not make any claim in this respect.

Personal data

Out of respect for the privacy of its Users, Implecio Sàrl undertakes that the collection and processing of personal information on this site comply with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the General Data Protection Regulation (GDPR). Implecio Sàrl guarantees the User a right to object to, access and rectify the personal data concerning them.

Limitation of liability

The information made available on this site is provided for information purposes only and does not constitute advice or a recommendation of any kind. Consequently, the use of the information and content available on the site cannot engage the liability of Implecio Sàrl in any way. The User further undertakes to indemnify Implecio Sàrl for any harmful consequences directly or indirectly related to their use of the Service. It is the User’s responsibility to take all necessary measures to protect their own data. Implecio Sàrl nevertheless undertakes to implement all necessary means to guarantee the security and confidentiality of the data transmitted.

Force majeure

Implecio Sàrl cannot be held liable in the event of force majeure or events beyond its control.

Duration, applicable law and jurisdiction

This legal notice applies for an indefinite period from the User’s first use of the Service.

Contracts and agreements issued by Implecio Sàrl are governed by Swiss law. Domicile is elected at the registered office of Implecio Sàrl. Any dispute relating to the performance of a contract or agreement, to payment, or to the interpretation or performance of these terms is subject to Swiss law; articles 394 et seq. of the Swiss Code of Obligations apply for the remainder. Any subsequent dispute concerning the interpretation or performance of these terms falls within the jurisdiction of the ordinary courts of the canton of Geneva.
